Types of Damages

In Florida, two types of damages may be available in personal injury claims: compensatory and punitive. Compensatory damages are intended to compensate you for the losses and expenses related to the injury. 

These can include past and predicted future medical expenses associated with the injury, such as hospital bills, doctor's visits, diagnostic tests, medication, and physical therapy; lost wages or reduced earning capacity due to inability to work; property damage, such as to your car or motorcycle; pain and suffering; emotional distress; and loss of enjoyment of life if you have lost the ability to engage in activities you once enjoyed prior to the accident.   

On the other hand, punitive damages are intended to punish the defendant for their wrongdoing and deter similar behavior in the future. Punitive damages are only awarded in cases where the defendant's behavior was particularly egregious or reckless.

Florida does not impose caps on compensatory damages. However, punitive damages are generally limited to three times the amount of compensatory damages or up to $500,000, whichever is greater.
